I. LEGAL INFORMATION AND ACCEPTANCE.

These provisions regulate the use of the Internet portal service (hereinafter, the ‘Portal’) provided by PROPERTY LAWYERS for Internet users.

Access to the website is free, except for the cost of the connection through the telecommunications network supplied by the access provider contracted by users. Certain services are exclusive to our clients, and their access is restricted.

The use of the Portal attributes the status of user of the Portal (hereinafter, the ‘User’) and implies acceptance of all the conditions included in this Legal Notice. The provision of the Portal service has a limited duration at the time when the User is connected to the Portal or any of the services provided through it. Therefore, the User must carefully read this Legal Notice each time they intend to use the Portal since this and its conditions of use contained in this Legal Notice may be modified.

II. DATA PROTECTION.

The data collected through the data collection forms on the Portal will be incorporated into an automated file of personal data for which María Solana Seguí – PROPERTY LAWYERS is responsible. This entity will treat the data confidentially and exclusively for the purpose of managing the relationship with its clients and promoting the activities of the Law Firm. Likewise, María Solana Seguí – PROPERTY LAWYERS will cancel, delete, and/or block the data when they are inaccurate, incomplete, or are no longer necessary or relevant for their purpose, in accordance with the provisions of the data protection legislation.

By clicking on the ‘send’ button of the corresponding form, the User expressly consents to the use of their data for sending commercial communications by email or by any other means. However, the User may object to the sending of such communications by checking the box provided for this purpose in each of the forms. Likewise, each of the commercial communications will expressly indicate the procedure enabled to oppose the sending of new commercial communications.

In the data collection forms, the fields marked with an asterisk are mandatory, so if the User does not provide the corresponding data, María Solana PROPERTY LAWYERS may, at its sole discretion, deny the corresponding service.

The User may revoke the consent given and exercise their rights of access, rectification, cancellation, and opposition by addressing the address indicated in clause 1.

PROPERTY LAWYERS adopts the security levels required by the Security Measures Regulation approved by Royal Decree 1720/2007, of December 21, which approves the Regulation for the development of Organic Law 15/1999, of December 13, on the Protection of Personal Data. However, technical security on the Internet is not impregnable, and leaks may occur due to malicious actions by third parties.

PROPERTY LAWYERS may use cookies during the provision of the Portal service. Cookies are automatic procedures for collecting information about the preferences determined by a user during their visit to a certain website. This information is recorded in small files that are stored imperceptibly on the corresponding user’s computer equipment. Each time the user accesses the website in question, these files are automatically activated, configuring the website with the preferences indicated in previous visits. In short, cookies are physical files of personal information hosted on the user’s terminal and unequivocally associated with this terminal. Cookies cannot read the cookie files created by other providers.

The User has the possibility to configure their browser program to prevent the creation of cookie files or to be warned when this occurs. The Portal is accessible without the need for cookie options to be activated, although they may prevent the proper functioning of security mechanisms for exclusive services or certain services that require greater security. In general, the purpose of the Portal’s cookie files is to facilitate the User’s navigation.

 

III. TERMS OF USE OF THE WEB PORTAL.

III.I. GENERAL CONDITIONS.

The User undertakes to make proper use of the Portal in accordance with the Law and this Legal Notice. The User will be liable to María Solana Seguí PROPERTY LAWYERS or third parties for any damages that may be caused as a result of the breach of this obligation.

The use of the Portal for purposes that are harmful to PROPERTY LAWYERS’ assets or interests, or that in any other way overload, damage, or disable PROPERTY LAWYERS’ computer networks (hardware) or products and computer applications (software), or those of third parties, is expressly prohibited.

III.II. CONTENTS OF THE PORTAL.

The User agrees to use the Contents in accordance with the Law and this Legal Notice, as well as with the other conditions, regulations, and instructions that may be applicable in accordance with clause 1.

By way of example, the User, in accordance with current legislation, must refrain from:

– Reproducing, copying, distributing, making available, publicly communicating, transforming, or modifying the Contents, except in cases authorized by law or expressly consented to by María Solana Seguí – PROPERTY LAWYERS or by the holder of the exploitation rights, if applicable.

– Reproducing or copying for private use the Contents that may be considered Software or Databases in accordance with current legislation on intellectual property, as well as their public communication or availability to third parties when such acts necessarily imply reproduction by the User or a third party.

– Extracting and/or reusing all or a substantial part of the Contents that make up the Portal as well as the databases that PROPERTY LAWYERS makes available to Users.

III.III. DATA COLLECTION FORMS.

Without prejudice to the provisions of clause 5 of this Legal Notice, as well as the privacy policies accessible from the Portal and which may be applicable at any given time, the use of certain services or requests directed to PROPERTY LAWYERS is conditioned upon the prior completion of the corresponding User registration.

All information provided by the User through the forms on the Portal for the aforementioned purposes or any other purposes must be truthful. To this end, the User guarantees the authenticity of all data communicated and will keep the information provided to PROPERTY LAWYERS perfectly updated so that it responds at all times to the real situation of the User. In any case, the User will be solely responsible for any false or inaccurate statements made and for the damages caused to PROPERTY LAWYERS or third parties by the information provided.

III.IV. INTRODUCTION OF LINKS TO THE PORTAL

Internet users who want to introduce links from their own web pages to the Portal must comply with the following conditions, without the lack of knowledge of these conditions relieving them of the responsibilities arising from the Law:

– The link will only link to the home page or main page of the Portal but may not reproduce it in any way (inline links, copying of texts, graphics, etc.).

– It will be expressly prohibited, in accordance with the applicable and current legislation at any time, to establish frames or frames of any kind that envelop the Portal or allow the display of the Contents through Internet addresses other than those of the Portal and, in any case, when they are displayed together with contents unrelated to the Portal in a way that: (I) produces or may produce error, confusion, or deception in users about the true origin of the service or Contents; (II) constitutes an act of unfair comparison or imitation; (III) is otherwise prohibited by current legislation.

The page that establishes the link must faithfully comply with the law and may not, under any circumstances, provide or link to its own or third-party contents that: (I) are unlawful, harmful, or contrary to morality and good customs (pornographic, violent, racist, etc.); (II) induce or may induce the User to a false conception that PROPERTY LAWYERS subscribes to, supports, adheres to, or in any way endorses the ideas, statements, or expressions, whether lawful or unlawful, of the sender; (III) are inappropriate or not relevant to the activity of PROPERTY LAWYERS in terms of the place, content, and subject matter of the sender’s website.

IV. INDUSTRIAL AND INTELLECTUAL PROPERTY.

All the contents of the Portal, including but not limited to texts, photographs, graphics, images, icons, technology, software, links, and other audiovisual or sound contents, as well as their graphic design and source codes (hereinafter, the ‘Contents’), are intellectual property of María Solana Seguí or third parties, and no exploitation rights recognized by the current legislation on intellectual property over them may be understood to be assigned to the User, except for those that are strictly necessary for the use of the Portal.

The trademarks, trade names, or distinctive signs are the property of María Solana Seguí or third parties, and access to the Portal shall not be understood as granting any rights over said trademarks, trade names, and/or distinctive signs.

V. DISCLAIMER.

V.I. GENERAL ISSUES REGARDING THE INFORMATION ON THE WEBSITE.

Access to the Portal does not imply any obligation on the part of María Solana PROPERTY LAWYERS to verify the truthfulness, accuracy, suitability, adequacy, completeness, and timeliness of the information provided through it. The contents of this page are of a general nature and do not constitute, in any way, the provision of a legal or tax advisory service of any kind, so such information is insufficient for making personal or business decisions by the User.

María Solana PROPERTY LAWYERS is not responsible for decisions made based on the information provided on the Portal or for damages and losses suffered by the User or third parties due to actions taken solely on the basis of the information obtained on the Portal.

V.II. ABOUT THE QUALITY OF THE PROVIDED SERVICE.

Access to the Portal does not imply any obligation on the part of PROPERTY LAWYERS to control the absence of viruses or any other harmful computer elements. It is the responsibility of the User, in any case, to have adequate tools for detecting and disinfecting harmful computer programs.

María Solana Abogados is not responsible for the damages caused to the computer equipment of Users or third parties during the provision of the Portal service.

V.III. ABOUT THE AVAILABILITY OF THE WEB SERVICE.

Access to the Portal requires services and supplies from third parties, including transportation through telecommunications networks, the reliability, quality, continuity, and operation of which do not correspond to María Solana PROPERTY LAWYERS. Therefore, the services provided through the Portal may be suspended, canceled, or become inaccessible, prior to or simultaneously with the provision of the Portal service.

PROPERTY LAWYERS is not responsible for any damages or losses of any kind caused to the User that may result from failures or disconnections in telecommunications networks, resulting in the suspension, cancellation, or interruption of the Portal service during its provision or prior to it.

V.IV. LINKED CONTENTS AND SERVICES THROUGH THE PORTAL.

The service of access to the Portal includes technical devices of linking, directories, and even search instruments that allow the User to access other Internet pages and portals (hereinafter, ‘Linked Sites’). In these cases, PROPERTY LAWYERS acts as a service provider of intermediation in accordance with article 17 of Law 34/2002, of July 12, on Information Society Services and Electronic Commerce (LSSI), and will only be responsible for the Contents and services provided on the Linked Sites to the extent that it has actual knowledge of their illegality and has not disabled the link with due diligence. In the event that the User considers that there is a Linked Site with illicit or inadequate content, they may communicate it to PROPERTY LAWYERS, in accordance with the procedure and effects established in clause 6, without this communication implying, in any case, the obligation to remove the corresponding link.

In any case, the existence of Linked Sites should not presuppose the existence of agreements with the responsible parties or owners of the same, nor the recommendation, promotion, or identification of PROPERTY LAWYERS with the statements, contents, or services provided.

PROPERTY LAWYERS does not know the contents and services of the Linked Sites and is therefore not responsible for damages caused by the illegality, quality, obsolescence, unavailability, error, and uselessness of the contents and/or services of the Linked Sites or for any other damage not directly attributable to PROPERTY LAWYERS.

VI. ILLEGAL OR INADEQUATE ACTIVITIES.

If the User or any other Internet user becomes aware that the Linked Sites link to pages whose contents or services are illegal, harmful, denigrating, violent, or contrary to morality, they may contact María Solana Seguí Abogada and provide the following information:

– Personal data of the complainant: name, address, telephone number, and email address;

– Description of the facts that reveal the illegal or inadequate nature of the Linked Site;

– In the event of violations of rights, such as intellectual and industrial property, the personal data of the owner of the infringed right when this is a different person from the complainant.

– The complainant must also provide the title that proves the legitimacy of the holder of the rights and, where appropriate, the representation to act on behalf of the holder when the latter is a person other than the complainant;

– Express statement that the information contained in the complaint is accurate.

Receipt by PROPERTY LAWYERS of the communication provided for in this clause shall not, in accordance with the LSSI, constitute effective knowledge of the activities and/or contents indicated by the complainant.

VII. LEGAL JURISDICTION.

This Legal Notice is governed in all and each of its aspects by Spanish law, and the jurisdiction in case of a dispute shall be that of the Courts of Alicante.
